JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the first information report and it appears from perusal of the impugned order that in course of investigation, co-accused, Bharat Bhushan was remanded in this case on suspicion and the aforesaid co-accused made his confessional statement disclosing the name of petitioner. The petitioner was also remanded in this case on the basis of aforesaid confessional statement and suspicion.

Submission on behalf of the petitioner is that petitioner was earlier made accused in a criminal case but when got bail, he was made accused in several other cases which had

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sadar at Motihari, East Champaran in connection with Madhuban P.S.
