JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-02-2021 Heard Mr. Pramod Kumar, learned counsel for the petitioner and Mr. Lal Babu Prasad, learned counsel for the informant. The State is represented by the learned APP. The petitioner seeks bail in anticipation of his arrest in connection with Mehandiganj P.S. Case No. 124 of 2020, dated 22.07.2020, instituted for the offences under Sections 341, 323, 448, 504, 509, 354, 354(A) and 354(D) of the Indian Penal Code.
Considering the nature of accusation against the petitioner, I am not inclined to grant anticipatory bail to him; notwithstanding the fact that there is a counter version of
Patna High Court CR. MISC. No.32492 of 2020(2) dt.12-02-2021 2/2 the occurrence as well.
The prayer for grant of anticipatory bail of the petitioner is, accordingly, rejected.
However, if the petitioner surrenders before the Court below and seeks regular bail, the Court below shall consider the case on its own merits, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
