The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 308, 379 and other allied sections of the Indian Penal Code. Later on, section 307 IPC has been added.

As per the prosecution case, seven FIR named including petitioners and 40-50 unknown persons having variously armed came at the house of informant. Co-accused Bablu Singh assaulted the informant with iron rod on his head causing head injury, snatched ornaments from his possession and also damaged his house.

Patna High Court CR. MISC. No.34490 of 2022(2) dt.15-11-2022 2/2 It is submitted that specific accusation of assault is against co-accused Bablu Singh. So far as these petitioners are concerned, there is no allegation of assault. Petitioners claim clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. Case No. 136 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
