JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 05.04.2016 At the very outset, learned counsel for the informant expresses his inability to file counter affidavit on the ground that informant could not reach to this court whereas learned counsel for the petitioner submits that as per his instruction, complaint case bearing Complaint case no. 3564/2009 has already been dismissed in the year 2011.

Heard learned counsels for the parties.

Petitioner seeks bail in a case registered under section 379 of the Indian Penal Code.

No doubt, petitioner is named in the first information report but it appears that only suspicion has been raised against the petitioner who is languishing in jail custody since 11.12.2015 and, admittedly, nothing was recovered from his conscious possession. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on
