The petitioner has preferred this application for grant of regular bail in a case registered under sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, it is stated that in course of investigation of one of the cases, ten accused persons including the petitioner herein were arrested and on the information provided by the four arrested accused persons including the petitioner, a raid was conducted in the house of Dharmendra Sahni and various incriminating articles were recovered.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No

Patna High Court CR. MISC. No.43694 of 2021(2) dt.24-01-2022 2/2 incriminating article has been recovered from his possession. The petitioner is in custody since 26.12.2020 and has been falsely implicated in one another case. Chargesheet has been submitted in the case.

The application for bail is opposed by learned A.P.P. for the State who submits that the petitioner is named in the F.I.R. and it is on the statement of the accused persons including the petitioner herein, the arms and ammunitions were recovered.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Birpur P.S. Case no.177 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI, Begusarai.
