As per the previous orders dated 17.06.2020 and 17.08.2020 supplementary counter affidavit has been filed on behalf of the State yesterday.
Ms. Deepanjali Gupta, learned AC to GP-10 is present on behalf of the State. She has read over paragraph '6' and '7' of the supplementary counter affidavit stating that the petitioner has already been paid his pension amount of Rs. 95,996/-, gratuity Rs. 7,58,967/- and commutation of pension Rs. 8,29,888/-. Learned counsel submits that in the earlier counter affidavit copy of which was served on learned counsel for the petitioner it was
Patna High Court CWJC No.12479 of 2019(5) dt.19-08-2020 2/2 categorically mentioned that the GPF amount has been deposited with the bank account of the petitioner and steps were also taken to pay the group insurance amount. It is, thus, submitted that now in view of Annexure 'A' to the supplementary counter affidavit filed on behalf of the State nothing remains due to the petitioner. As regards request for transfer of Bank and payment of pension through Allahabad Bank at Patna steps have been taken by the State respondents. It is, thus, submitted that now this writ application has become infructuous.
Considering the aforesaid submission of learned counsel for the State and the specific affidavit already on record as also that learned counsel for the petitioner is not putting any appearance despite link sent to him and no request for adjournment has been made even on any other ground, this Court is of the considered opinion that the writ application is to be disposed of as having become infructuous.
