JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but during the course of investigation, when the further statement of the informant was recorded and the photograph of the petitioner was shown to him, he claimed to have identified the petitioner. Submission on behalf of the petitioner is that petitioner was arrested by the police in a case of Arms Act and, subsequently, petitioner was made accused in the present case also on the basis of aforesaid photograph and, moreover, the T.I.P of the petitioner has not been done in accordance with law. Considering the aforesaid facts and circumstances as well as above stated submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.

Patna High Court Cr.Misc. No.13226 of 2016 (2) dt.01-04-2016 2/2 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Banka P.S.No.671 of 2015.
