JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-06-2022 The present writ petition has been filed for payment of retiral dues of the petitioner pertaining to gratuity, leave encashment, arrear of pension on the basis of pay fixed after grant of increment on account of grant of 1st, 2nd and 3rd Financial Progressions under the Assured Career Progression and Modified Assured Career Progression scheme, deferred dearness allowance and the other admissible outstanding retiral dues.

The petitioner is stated to have superannuated on 30.11.2012 from the post of Re-designated Demonstrator of Botany Department, H.P.S. College, Madhepur, Madhubani

Patna High Court CWJC No.17789 of 2018(14) dt.20-06-2022 2/2 under the L.N. Mithila University, Darbhanga. The learned counsel for the Respondents University, Md. Nadim Seraj, has submitted that all the retiral benefits including the deferred amount of dearness allowance have already been paid to the petitioner as would be apparent from the various counter affidavits filed in the present case from time to time.

The learned counsel for the petitioner submits that in case any outstanding retiral dues are remaining to be paid, the petitioner be granted liberty to approach the respondent authorities.

Accordingly, the present writ petitions stands disposed of, however, with liberty to the petitioner to approach the appropriate authority in case of any subsisting grievances. (Mohit Kumar Shah, J) Tiwary/- U
