The petitioner is in custody since 20.11.2014 in connection with Patahi P.S. Case No. 78 of 2014 registered under sections 302 and 201/34 IPC. The prosecution case in brief is that on the date of occurrence two accused persons named in the FIR (not the petitioner) took the victim to visit a Mela. He did not return and subsequently his dead body was found. It is submitted that except suspicion there no direct material to incriminate the petitioner in the crime. The suspicion raised against the two accused persons who took the victim along have since been released on bail by this Court vide order

Patna High Court Cr.Misc. No.19724 of 2015 (2) dt.07-07-2015 2/2 dated 9.06.2015. The petitioner has no criminal antecedent. Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sri Devesh Kumar, Judicial Magistrate, 1st Class Sikrahna, Motihari in Patahi P.S. Case No. 78 of 2014 on condition that one of the bailors shall be own/close family member of the petitioner. As soon as the charges are framed, the petitioner shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall cancel his bail bonds.
