Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but according to the prosecution case itself, some unknown persons had committed murder of the deceased and at the time of alleged occurrence, petitioner was in jail custody. The informant has only expressed his suspicion against the petitioner. Moreover, submission on behalf of the petitioner is that the petitioner was in jail custody since 8.07.2013 to 21.01.2016 in connection with Telco P.S.Case No. 176 of 2013 and he was acquitted in the aforesaid case on 21.01.2016. It is submitted that except suspicion,

Patna High Court Cr.Misc. No.13221 of 2016 (2) dt.01-04-2016 2/2 there is nothing against the petitioner and, moreover, some coaccused having more or less similar allegation, have already been granted privilege of bail by a co-ordinate Bench of this Court. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Piro P.S.Case No. 89 of 2015.
