The petitioner seeks regular bail in connection with Kurtha P.S. Case No. 26 of 2019 for the offences punishable under Sections 414 of the Indian Penal Code.

The case of the prosecution is that the police personnel got an information on the alleged date and time of the occurrence that the petitioner was waiting for sale of stolen motorcycle whereafter the police party arrived at the place of occurrence and arrested the petitioner with the stolen motorcycle since he could not produce registration document, upon being asked to produce the same.

The learned counsel for the petitioner submits that the petitioner is having a clean antecedent and is languishing in

Patna High Court CR. MISC. No.33727 of 2019(3) dt.17-08-2019 2/2 custody since 18.02.2019. It is further submitted that for the purposes of showing his bonafide, the petitioner is ready to deposit a sum of Rs. 10,000/- in cash before the Nazarat of the concerned trial court.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct for release of the petitioner on regular bail subject to deposit of a sum of Rs.10,000/- in cash in the Nazarat of the Arwal Civil court, whereupon the petitioner, above named, shall be enlarged on regular bail on such conditions as may be deemed fit and proper to be imposed by the learned court of Chief Judicial Magistrate, Arwal in connection with Kurtha P.S.
