JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 307/120B and other ancillary sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, accused persons are alleged to have made firing on the informant as a result of which he sustained fire arms injury.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case and the allegation of firing is against co-accused Chandu Bishwas and petitioner is said to have been standing besides the said co-accused Chandu Bishwas on the place of occurrence at the relevant time. Petitioner has claimed

Patna High Court CR. MISC. No.45215 of 2021(2) dt.15-11-2021 2/2 clean antecedent and he is in custody since 27.3.2021. Investigation is complete.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran, Bettiah in Shikarpur Police Station Case No. 172 of 2021.
