Petitioner seeks bail in a case registered under section 399, 402, 414 of the Indian Penal Code as well as sections 25 (I-b)a, 26,35 of the Arms Act.

Only one mobile set is said to have been recovered from conscious possession of the petitioner when petitioner and others assembled to make preparation for committing dacoity. So far as criminal antecedent of the petitioner is concerned, prior to institution of the present case, only one case had been lodged against him.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in Rajgir P.S. Case no. 09/2016. shahid (Hemant Kumar Srivastava,J) U T
