Counsel for the petitioner submits that he was an employee of H.P.C.L Bio Fuels Company Limited and was not allowed to join the company on account of pending criminal case vide Sangrampur P.S. Case No.149 / 2015 under Sections 302/34 of the Indian Penal Code, but he has been

Patna High Court CWJC No.11216 of 2019(3) dt.25-07-2019 2/2 acquitted from that case and after acquittal, he has reported to the Company for his joining, but the Company has refused to allow him in service.

Counsel for the respondents submits that he has remained absent for a long period without any information and, as such, the question of his entry does not arise. Counsel for the petitioner submits that he has filed a representation before the respondent authority, which is pending since long and that representation should be decided one way or other by the Authority.

In such view of the matter, the petitioner is directed to file a fresh representation before the General Manager, HPCL Bio Fuels Limited. If such representation is filed, he will consider the same and take a decision in accordance with law. (Shivaji Pandey, J) V.K.Pandey/- U
