17-05-2021 The matter has been taken up for hearing on-line because of COVID-19 Pandemic restrictions.

It is stated by learned counsel appearing on behalf of the State that a counter affidavit has been filed stating therein that the petitioner's statutory appeal is still pending and could not be decided because of prevailing COVID-19 Pandemic and subsequent upsurge of cases in the second wave. He has further

informed that quasi judicial authorities under the State of Bihar have been asked to discharge their functions through on-line mode for disposal of matters before them.

Mr. Dhirendra Narain Mallik, learned counsel for the petitioner has submitted that despite the fact that the petitioner's counsel presented himself before the appellate authority on each and every date, the statutory appeal has yet not been disposed of even after lapse of one year and two months.

Considering the facts and circumstances of the case, this application is disposed of with a direction that let the appeal be decided within three months from the date of receipt/production of a copy of this order.
