The petitioner is languishing in custody since 28.02.2018 in a case for the offence registered under Sections 413, 414, 467, 468 and 420 of the IPC.

The prosecution story, in brief, is that on the alleged date and time of occurrence, the informant apprehended the petitioner with a stolen Motorcycle without registration number and mobile. Thereafter, on his disclosure, other co-accused Bitu Kumar Ram, Prakash Yadav and Guddu Chauhan have also been arrested.

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent.

Patna High Court CR. MISC. No.31604 of 2019(2) dt.13-05-2019 2/2 Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner has got no concern with alleged Motorcycle in question. The motorcycle in question does not belong to the petitioner. He has been made accused in the present case due to mistake of fact.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail after completion of six months in custody on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-XII, Gopalganj, in connection with Bhore P.S.
