Mr. Milind Kumar Mishra ====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 18-06-2025 Heard learned counsel for the petitioner and learned counsel for the informant as well as learned A.P.P for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Dhanaha P.S. Case No. 32 of 2025 dated 07.02.2025 registered for the offences punishable u/ss 126(2), 115(2), 76, 324(4), 64, 62 of the BNS and section 12 of the POCSO Act.

3. As per the prosecution case, the petitioner is alleged to have caught the informant's minor daughter from behind with bad intention and tried to sexually assault her.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.35843 of 2025(2) dt.18-06-2025 2/2 this case. The allegation against the petitioner is of only outraging the modesty of the informant's minor daughter. There is no specific allegation of sexual assault against the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 08.02.2025.

5. Learned counsel for the informant as well as learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bettiah, West Champaran in connection with Dhanaha P.S. Case No. 32 of 2025.

7. The application stands allowed.
