JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 22.09.2015 Supplementary affidavit is filed on behalf of the petitioner. Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State and also heard learned counsel for the informant.

Petitioner is in jail custody since 12.3.2015 on the accusation that he opened fire causing firearm injury on the right scapular region of the informant but in course of investigation, when the injury report of the informant was obtained, it was found that the informant sustained one injury on his chest and opinion regarding the aforesaid injury was kept reserved. The Investigating officer submitted charge sheet against the petitioner without obtaining complete injury report.

Moreover, petitioner has also lodged criminal case on the same day making allegation of assault against the informant of the present case and others.

Patna High Court Cr.Misc. No.19530 of 2015 (3) dt.22-09-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in Gogri P.S. Case no. 101/2015.
