JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be younger brother-in-law of the deceased and according to prosecution case itself, the marriage of the deceased had taken place 7-8 years ago but even then, the police registered the case under Sections-304B, 201/34 of the Indian Penal Code.
No doubt, the deceased appears to have died in other than normal circumstances and some injuries were found on the person of the deceased but submission on behalf of petitioner is that the petitioner does not have any concern with the affairs of husband of the deceased and moreover, except suspicion, there is nothing against the petitioner. It is also pointed out that husband of the deceased has already been sent to judicial custody.
Patna High Court Cr.Misc. No.12991 of 2016 (2) dt.01-04-2016 2/2 Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Tikapatti P.S. Case No. 133 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate, Purnea.
