JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Complaint Case No. 1094 of 2012, corresponding to Trial No. 1915 of 2019, instituted for the offences punishable under Sections 420, 406 of the Indian Penal Code and Section 138 of N.I. Act.

As per complaint petition there is allegation that petitioner No.1 issued a cheque in favour of opposite party No.2 and on presentation the same has been dishonoured. Submission of learned counsel for the petitioners is that there was business dealing between the petitioners and complainant and in lieu of that he has given cheque for security

Patna High Court CR. MISC. No.35007 of 2019(4) dt.25-09-2019 2/2 purpose which the complainant has produced and that has been dishonoured and there is no other allegation against them. Heard learned APP also.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Judge-X-cum-Additional Chief Judicial Magistrate, Muzaffarpur, in connection with Trial No. 1915 of 2019, arising out of Complaint Case No. 1094 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
