JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 323, 342, 354(B), 452, 504, 506/34 of the Indian Penal Code, Section 3 (i) (x) of S.C./S.T. (Prevention of Atrocities) Act and Section 3⁄4 of Dayan Act.
There is accusation against the petitioner that he along with others assaulted the informant and her husband and also called her caste name with an intent to humiliate her and furthermore, they made attempt to put night soil into the mouth of the informant.
Contention on behalf of the petitioner is that the
Patna High Court Cr.Misc. No.12452 of 2016 (2) dt.18-03-2016 2/2 present case has been lodged by the informant in retaliation of Complaint Case No. 517 of 2015 which had been filed by the petitioner on 26.05.2015 against the husband of informant for the occurrence of 15.05.2015. It is further submitted that alleged occurrence is said to have taken place on 18.09.2015 but the informant filed complaint case on 07.10.2015 and on the basis of aforesaid complaint case, first information report was lodged on 03.01.2016 and no explanation of the aforesaid delay has been given.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Chautarwa P.S. Case No. 01 of 2016. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
