1. Heard learned counsel for the petitioner and learned A.P.P. for the State along with the learned counsel for the informant.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 341, 323, 324, 379, 34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that in Cr. Misc. No. 31490 of 2023, the petitioner Kamlesh Ray along with others have been granted the privilege of anticipatory bail and in the said case, the case of the petitioner has also been considered, it is further submitted that for the same occurrence, two FIRs have been instituted and when this petitioner got police bail on 01.08.2022, thereafter, the informant instituted the present FIR when his father earlier for the same occurrence had instituted Gaurichak P.S. Case No. 497 of 2022.

4. Learned counsel for the petitioner submits that the petitioner is on police bail in Gaurichak P.S. Case No. 497 of 2022 which was instituted by the father of the present informant but in the present FIR he is not on police bail and thus apprehends his arrest and the facts of the case in detail has been considered in Cr. Misc. No. 31490 of 2023.

5. Learned A.P.P. for the State along with learned counsel for the informant opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Gaurichak P.S. Case No. 204 of 2023 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
