Learned counsel for the petitioners seeks permission to withdraw the anticipatory bail petition of Petitioner no. 3 and petitioner no. 4 as they have already been arrested during pendency of this case.

Prayer is allowed. The anticipatory bail petition of petitioner no. 3 and 4 are dismissed as withdrawn. This application has been filed for modification of

Patna High Court CR. MISC. No.27187 of 2020(2) dt.16-10-2020 2/2 order dated 05.03.2020 passed in Cr. Misc. No. 66989 of 2019, for extension of period.

Learned counsel for the petitioners has submitted that earlier petitioners were granted anticipatory bail by order dated dated 05.03.2020 passed in Cr. Misc. No. 66989 of 2019, whereby petitioners were directed to surrender before the court below within a period of six weeks from the date of the order, but the petitioners could not surrender in time due to Covid-19 pandemic.

In view of the reasons assigned in the modification petition, ten weeks further time from the date of receipt of this order is allowed to the petitioner no. 1 and 2 to surrender in the court below.
