The petitioner is languishing in custody in a case registered for the offences punishable under Sections 366A, 372 and 506/34 of the Indian Penal Code.
The accusation is of kidnapping the minor daughter of the informant Anguri Nesha. In 164 Cr.P.C. statement the victim has got her age recorded as 14 years when the court has assessed as such where she has stated that this petitioner, Makaiya Babu and Sita took her to the house of Santosh when she came to know that they were talking to sell her then she came back to her parents.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.21198 of 2015 (2) dt.09-07-2015 2/2 petitioner that FIR suggests that none misbehaved with her and subsequently the informant has retracted from the initial version and filed a petition to that effect before the learned court below. The same has been brought on record as Annexure-2. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkauliya (Banjaria) P.S. Case No. 557 of 2014.
