JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 457, 380 of the Indian Penal Code.
It is a case of long misuse of privilege of bail and it appears from the impugned order that petitioner is habitual and he has no respect for the court and law.
Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Chapra Muffasil (Nagara) P.S. Case No. 176 of 1996 pending in
Patna High Court Cr.Misc. No.20327 of 2016 (2) dt.09-05-2016 2/2 the court of Sri B.B. Rai, Judicial Magistrate 1st Class, Chapra stands rejected.
However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably within four months from the date of receipt/production of copy of this order, failing which the petitioner may renew his prayer for bail before the learned court below itself.
