JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-12-2020 In view of the submission and the undertaking of the learned counsel for the petitioners, at the time of hearing of this application through video conferencing, that he would remove the defect(s), as pointed out by the office vide its notes dated 04.12.2020, within two weeks of starting of the Court proceeding in physical mode, he is permitted to remove the same accordingly.

Heard learned counsel for the petitioners and the learned A.P.P. for the State through video conferencing. The petitioners seek bail in connection with Complaint Case No. C-2 / 225 of 2020 for the offence under

Patna High Court CR. MISC. No.33033 of 2020(2) dt.16-12-2020 2/2 Section 30(A) of the Bihar Prohibition and Excise Act, 2016. The accusation is recovery of 1200 bottles Nepali liquor in volume of 360 liters from possession of Sanichar Manjhi (Petitioner No.1), Baidhnath Mahto (Petitioner No.2), Sat Narayan Manjhi and Harinandan Kumar, while two persons succeeded to flee away.

Learned counsel appearing for the petitioners submits that, in fact, petitioners were pedestrian at the time of occurrence, but they have falsely been implicated in this case. Further submission is that petitioners have no criminal antecedent and they are in custody since 07.06.2020. Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J-II-cum- Special Judge, Excise Act, Sitamarhi in connection with Complaint Case No. C-2 / 225 of 2020.
