JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-04-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report and there is allegation against them that they assaulted the informant with lathi, fists and slaps. So far as, deceased is concerned, it is obvious from perusal of the first information report that he was assaulted by the other accused.

Earlier petitioners and some other accused were granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 13.03.2012 passed in Cr. Misc. No. 7415 of 2012 but the aforesaid privilege of anticipatory bail was quashed by Apex Court of this country in Cr. Appeal No.1423-1426 of 2013

Patna High Court Cr.Misc. No.4726 of 2015 (3) dt.24-04-2015 2/2 and petitioners were directed to surrender before the police. It is submitted on behalf of the petitioners that no injury report of informant is on the entire case diary and as a matter of fact, the informant did not receive any injury. It is contended by him that petitioners surrender before the court below in the light of direction given by the Apex Court of this country. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of allegation leveled against the petitioners, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Session Judge -V, Saran, Chapra in connection with Marhowrah P.S.Case No. 258 of 2011.
