Petitioner being Gotni of the deceased has been made accused in a case registered under section 302, 201/34 of the Indian Penal Code and is languishing in jail custody since 19.08.2014.

The only allegation against her is that she established physical relation with husband of the deceased and at her instigation the husband of the deceased committed murder of the deceased.

In course of investigation, the daughter of the petitioner at Para-5 of the case diary states that when she returned to her

Patna High Court Cr.Misc. No.4728 of 2015 (3) dt.24-04-2015 2/2 home, her younger sister informed that burnt dead body of her aunt was taken away by husband of the deceased. It would appear from materials available on the case diary that except the so called illicit relation of the petitioner with husband of the deceased, there appears to be nothing against her. Accordingly, above named, petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, Chapra at Saran in connection with session trial no. 626 of 2014 arising out of Ekma Police station Case No. 110 of 2014.
