JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, he was arrested and part of the looted money is said to have been recovered from his possession. Para-68 of the case diary reveals that the Investigating officer obtained the description of looted money from the concerned Bank and para-72 of the case diary reveals that only one note of Rupees ten of the above stated description was found from the amount recovered from the house of the petitioner. No doubt, petitioner carries criminal antecedent of several cases but having similar allegation, some co-accused have already been granted privilege of bail by a co-ordinate Bench of

Patna High Court Cr.Misc. No.4739 of 2015 (3) dt.24-04-2015 2/2 this court.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class in connection with Gayghat P.S.Case No. 78 of 2013. (Hemant Kumar Srivastava, J) Namita/- U T
