JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The victim has specifically stated in his statement that he was confined in the house of the petitioner and in course of investigation, the victim got identified the house of the petitioner before the police.

Considering the aforesaid statement of the victim as well as this aspect of the matter that the victim identified the house of the petitioner before the police, I am not inclined to release the petitioner on bail, and accordingly, his prayer for bail in connection with Nirmali P.S.Case No.53 of 2014, pending in the court of Chief Judicial Magistrate, Supaul stands rejected.
