JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 363, 363-A, 341, 323, 467, 468 of the Indian Penal Code.
The present case was lodged after recovery of victim girl and prior to institution of the present case, Kishanganj P.S. Case No. 453 of 2015 was lodged against the petitioners and others and in that case, petitioners were granted bail by the learned Additional Sessions Judge-I, Kishanganj.
It would appear from perusal of the first information report that victim got missing from her house and subsequently,
Patna High Court Cr.Misc. No.15673 of 2016 (2) dt.19-04-2016 2/2 she was found at Kishanganj Welfare Home and she disclosed that petitioners had taken away her and got employed her in begging profession and on the basis of aforesaid disclosure, Kishanganj P.S. Case No. 261 of 2015 was lodged and again the present case was lodged in Madhubani district on the basis of almost similar facts.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Madhubani in connection with Jainagar P.S. Case No. 269 of 2015.
