Petitioner in the present case is seeking regular bail in connection with Ganga Bridge P.S. Case No. 133 of 2018 registered for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that as per the FIR the informant's sister namely, Manju Devi married to the petitioner in the year 2012 was subjected to torture and cruelty on account of non-fulfillment of demand of dowry and ultimately she was killed and her dead body was thrown in river. Learned counsel for the petitioner submits that the petitioner is the husband of the deceased who was suffering from ailment for which treatment was provided to her but she could not survive. It is further submitted that the petitoiner is in custody since 09.06.2020.
Learned APP for the State has opposed the prayer for
Patna High Court CR. MISC. No.32587 of 2020(5) dt.12-01-2021 2/2 regular bail of the petitioner by submitting that the death of the petitioner's wife has taken place in his house and there is allegation of torture and cruelty for demand of dowry.
Having regard to the facts and circumstances of the case wherein the submission of learned counsel for the petitioner is that the deceased was suffering from some disease for which she was being treated in Apolo Nursing Home between 10.08.2019 to 05.09.2018 but these materials have not come in course of investigation and the petitioner being husband of the deceased and the death has taken place within four corners of his house and then there are allegations that he had killed the sister of the informant and then had not informed the family, even the dead bod was thrown, this Court is not inclined to grant regular bail to the petitioner at this stage.
Let the trial be expedited. Learned trial court is directed to proceed with the trial without granting unnecessary adjournments. This application stands disposed of.
