The petitioner seeks bail in anticipation of his arrest in connection with Chiraiya P. S. Case No. 84 of 2020, dated 10.03.2020, instituted for the offences under Section 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Patna High Court CR. MISC. No.35094 of 2020(2) dt.19-03-2021 2/3 One Santosh Kumar Yadav is said to have been arrested with 123 litres of liquor and he is stated to have named the petitioner and another as having fled away from that place during the raid.

The learned counsel for the petitioner has submitted that but for the confession of the arrested accused person, there is no other material to connect the petitioner with the offence.

The petitioner does not have criminal antecedents.

Considering the aforesaid facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Motihari, East Champaran, in connection with Chiraiya P. S. Case No.

Patna High Court CR. MISC. No.35094 of 2020(2) dt.19-03-2021 3/3 84 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C.

The application stands allowed.
