The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 323, 325, 307, 379, 353, 504 of the Indian Penal Code and 3(1)(x) of SC/ST (Prevention of Atrocities) Act. The prosecution case is that the informant being a police officer apprehended co-accused Santosh Kumar in connection with Aurangabad Town P.S. Case No. 521 of 2015 and took him to the police station when the employees of coaccused Santosh Kumar came, abused the informant by calling caste name and made assault with lathi and danda to the police

It is submitted by learned counsel for the petitioner that the petitioner is not the employee of co-accused Santosh Kumar and the accusation is not specific against the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent whereas co-accused Suman Kumar has been granted bail vide Cr. Misc. No. 10124 of 2016 by a co-ordinate Bench of this Court. Considering the thrust of accusation against co-accused Santosh Kumar, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. Case No. 50 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
