JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but admittedly, at the relevant time he was posted as SAP Jawan and according to written report of Raghopur P.S. Case No. 28 of 2008, petitioner and co-accused, Lakhendu Ahmad had opened fire in encounter. It is alleged in the aforesaid written report of Raghopur P.S. Case No. 28 of 2008 that co-accused Lakhendu Ahmad had made three round of firings whereas this petitioner is said to have made one round of firing. Para 39 of the case diary reveals that only one firearm injury was found on the person of the deceased. Admittedly, co-accused, Lakhendu Ahmad has already been granted privilege of bail by a co-ordinate Bench of this Court

Patna High Court Cr.Misc. No.3076 of 2015 (6) dt.24-04-2015 vide order dated 27.01.2015 passed in Cr. Misc. No. 3340 of 2015 and it is not clear as to whose firing deceased sustained. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Afzal Alam, Judicial Magistrate 1st Class, Vaishali at Hajipur in connection with Raghopur P.S.
