JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 02.12.2015 in a case registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code.

The informant claims that petitioner was caught on the spot just after the alleged kidnapping and according to prosecution case itself, the alleged occurrence took place in the morning of 28.11.2015 but the first information report was lodged on 01.12.2015 and it is not clear as to where the petitioner had been kept between 28.11.2015 to 01.12.2015 and furthermore, no explanation regarding the aforesaid delay has been given by the informant.

No.12603 of 2016 (2) dt.28-03-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 443 of 2015.
