JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-03-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 406,420,323,354 and 379 of the Indian Penal Code. It is alleged that the petitioners persuaded the informant for mortgage of 87 decimals of land and took rupees forty two thousand and mortgaged the land. Subsequently eighty thousand rupees were given to the petitioners for mortgage of three bighas of land of Plot No. 224 but the money was not returned and subsequently possession of land from the informant was also taken.

It is submitted by the learned counsel for the petitioners that there is no proof with regard to the payment and at earlier point of time 144 Cr.P.C. proceeding was initiated due to dispute

Patna High Court Cr.Misc. No.12658 of 2016 (2) dt.18-03-2016 2/2 between the parties. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the accusation levelled in the background of civil nature of dispute, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Rohtas at Sasaram in connection with Kargahar (Sirhi) P.S. Case No.279 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
