KUMAR ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 18-02-2020 This petition has been preferred praying inter alia for the following reliefs:- "That this application is being filed for directing the respondents to take immediate steps for removal of encroachment from the water body i.e. public Aahar, Gawahi and connecting village road from plot No. 320, 321 and 322 in Mauza Kachanath in Shivsagar Block of Rohtas district, since despite repeated request and representation made by the petitioner and other villagers to remove the encroachment in terms of government policy, the respondents are keeping mum."

Patna High Court CWJC No.17425 of 2017(3) dt.18-02-2020 2/2 From the affidavit dated 15.05.2018 filed by respondent Nos 3 to 6, it is apparent that notices already stand issued to encroachers for removing the encroachment over the water body in question.

As such, we dispose of the writ petition with a direction to the authorities to make sure by filing subsequent affidavit that the encroachment of water body is positively removed within a period of two months from the date of receipt/production of a copy of order passed by this Court.
