====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-12-2020 Heard Mr. Shivendra Kumar Sinha, learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Dharhara P.S. Case No. 71 of 2020 dated 27.04.2020 instituted for the offence under Sections 302 and 34 of the Indian Penal Code.

The son of the informant was found dead in a well. In fact, the informant was told about the missing of his son by the petitioner on telephone. The informant suspected the hands of four persons in the killing of the deceased including the petitioner. No reason has been assigned in the FIR regarding the motive or genesis of the occurrence. During the course of investigation, as it appears from the impugned order, witnesses viz.

Patna High Court CR. MISC. No.32466 of 2020(2) dt.08-12-2020 2/2 Sanjaydeo Marandi, Ruplal Murmu and Ramchand Hansda were examined whose statements have been recorded in paragraphs 6, 7 and 16 of the case diary and they have also expressed suspicion on the petitioner and others.

Learned counsel for the petitioner submits that the suspicion is without any basis. In fact, it has been urged on behalf of the petitioner that the informant is distantly related with the petitioner and there is no reason whatsoever for the petitioner to have committed the crime.

The petitioner is in custody since 04.06.2020. Regard being had to the gender of the petitioner and the nature of accusation against her as well as her period of custody, she is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Munger in connection with Dharhara P.S. Case No. 71 of 2020.
