Petitioner seeks bail in Nawada (Nagar) P.S. Case No.1488 of 2019 registered under Sections 395 and 397 of the IPC.
The informant alleged that while he was returning to his house, 5-6 persons intercepted him near railway crossing and after assaulting him snatched his money, mobile and other belongings including driving licence and Aadhar Card. It is submitted that the petitioner is not named in the F.I.R. The name of the petitioner surfaced in the case in the confessional statement of Shera Kumar Manjhi. Save and except the confession of Shera Kumar Manjhi, there is no material against the petitioner. The petitioner is in jail since 10.05.2020. Shera Kumar Manjhi has already been granted bail vide order
Patna High Court CR. MISC. No.33251 of 2020(2) dt.14-12-2020 2/2 passed in Cr.Misc.No.30280 of 2020. The case of the petitioner stands on better footing.
Taking into consideration the facts that the name of the petitioner surfaced in the case in the confessional statement of Shera Kumar Manjhi and the petitioner is in jail since 10.05.2020 but he has not been put on T.I.P. nor any incriminating article was recovered from possession of the petitioner, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada (Nagar) P.S.
