BAJANTHRI) Date : 14-07-2023 In the instant petition, the petitioner has prayed for the following relief:- "I) For quashing of the order dated 21.04.2023 issued vide Memo no. 226 of the Respondent no.3 has rejected the appeal filed by the petitioner without following the mandate of Clause-25 of Agreement No. SBD-

2/5 01/2018-19 since the Respondent no.3 without giving any kind of notice or opportunity of hearing to the petitioner, illegally reviewed the order dated 14.05.2022 of the Respondent no.4 on facts and laws.

ii) For quashing of the order dated 14.05.2022 of Respondent No.4 by which the R.N. 4 confirmed the order dated 18.11.2021 issued vide Memo no. 335 of the Respondent no.5 in respect of debarment of the petitioner for participation in future BID.

iii) For quashing of the order dated 18.11.2021 issued vide Memo no. 335 of the Respondent no.5 by which the petitioner has been debarred in taking participation in future BID for no fault of the petitioner.

iv) For quashing of the order dated 04.03.2022 issued vide Office order No. 74 of the Respondent no.5 by which the agreement has been unilaterally rescinded under clause 3 of the Agreement No. SBD-01/2018-19.

v) And /or other relief/relief(s) as this Hon'ble Court deems."

2. The petitioner has assailed the order dated 18.11.2021, vide Annexure-20, by which he has been debarred and consequential proceedings have been drawn. Feeling aggrieved by the same, he had exhausted the remedy of appeal before the Appellate Authority.

3. Perusal of the records, it is evident that

3/5 Superintending Engineer has exercised the power after deciding petitioner's grievance and thereafter Chief Engineer, both the officials have no power to invoke jurisdiction under the Rule 11 of Bihar Contractors Registration Rules, 2007. 2018 सिट अवरक सिमय बनीत जवानट कट उपररांत भनी कगुल आवमंवटत 06 ववाडर्ग में सिट शटष 03 ववाडर्ग में अबतक कवायर्ग प्रवारमंभ नहनी हलो पवायवा ह। अथर्धात् कवायर्ग कनी भचौवतक प्रगवत अब तक वसिर्ग 50% प्रवतशत हनी ह इसि प्रकवार वनमर्धाण कवायर्ग में एजटन्सिनी दवारवा बहगुत हनी लवापरववाहनी बरतनी गई ह। एजटन्सिनी दवारवा कवायर्ग कट प्रवत बरतनी गई वशवथलतवा कट कवारण सिहवायक अवभयमंतवा, ललोक स्ववास्थ्य अवर प्रमंडल, बटननीपगुर नट अपनट पतरांक 375 वदनरांक 15.09.2021 दवारवा उवचत कवार्गववाई वकयट जवानट कनी अनगुशमंसिवा कनी गई ह। तत्पश्चवात् सिहवायक अवभयमंतवा दवारवा उवचत कवार्गववाई करनट सिट सिमंबमंरनी अनगुशमंसिवा कट आललोक में इसि कवायर्धालय कट पतरांक 1693 वदनरांक 23.09.

2021 कट दवारवा सिमंवदटक दवारवा करवायट गयट कवायरमं कवा अद्यतन प्रवतवटदन कट सिवाथ सिमंवटदक कट ववरूद्ध एकरवारनवामवा कट शतरमं कट अनगुसिवार डनीबवार करनट हटतगु अनगुशमंसिवा वकयवा गयवा एजमेंसिनी मम ववन्ध्यववावसिननी कन्सिट्रक्शन कलो आवमंवटत कवायर्ग एकरवारनवामवा सिमंख्यवा - SBD-01 / 2018-19 कट सिमनीकलोपरवान्त यह पवायवा गयवा ह वक आवमंवटत कवायर्ग अब तक अपूणर्ग ह तथवा प्रगवत 50% प्रवतशत ह। इसि प्रकवार एजटन्सिनी दवारवा वनरर्धावरत अववर में यलोजनवा कट वनमर्धाण कवायर्ग कलो पूरवा नहनी वकयवा जवानवा पूणर्गरूपटण कवायरमं कट प्रवत उदवावसिनतवा एवमं लवापरववाहनी कवा द्यलोतक ह। उपरलोक्त ववणर्गत तथ्यकों एवमं सिहवायक अवभयमंतवा सिट प्रवाप्त अनगुशमंसिवा कट अनगुसिवार कवायर्ग वनष्पवादन में चपूक कट वलए ववभवागनीय आदटश सिमंख्यवा- 6 ए / वव03-105 / 2020-970 वदनरांक 18.06.

4. Perusal of the order, it is evident that there is no reference to show-cause notice dated 16.11.2021 and the petitioner's reply. In other words, it is a case of non-speaking order. Hence, impugned order dated 18.11.2021 (Annexure20), passed vide Office Order No. 335, by respondent no. 5, Executive Engineer, Public Health Division, Darbhanga stands set aside in the result consequential orders passed by next

5/5 Higher Authority i.e., respondent no.4, the Chief Engineer, Public Health Engineering Depart, Muzaffarpur Region, Muzaffarpur dated 14.05.2022 (Annexure-22), stands set aside and the matter is remanded to the Executive Engineer/Competent Authority to revisit to the matter from the stage of issuance of show-cause notice dated 16.11.2021 reads with petitioner's reply dated 17.11.2021. He is hereby directed to analyze each of the contention stated in the reply of the petitioner dated 17.11.2021 and proceed to pass a fresh speaking order. The above exercise shall be completed within a period of three months from the date of receipt of this order.

5. Accordingly, the present writ petition stands allowed.
