JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner happens to be husband of the deceased and in course of investigation; the informant and his family members supported the prosecution case. So far as co-villagers of the petitioner are concerned; they have stated that the deceased committed suicide.
Even if, it assumed that the deceased committed suicide, then also, there is allegation of demand of dowry as well as torture against the petitioner and admittedly, the deceased died within three years of her marriage.
Regard being had the facts and circumstances of the
Patna High Court Cr.Misc. No.4982 of 2015 (3) dt.24-04-2015 2/2 case as well as submissions of the parties, I am not inclined to extend the privilege of bail to the petitioner and, accordingly, his prayer for bail in connection with Pipra P.S. Case No. 62 of 2014 stands pending in the court of learned Additional Chief Judicial Magistrate, Motihari, East Champaran stands rejected at least, at this stage.
