Petitioner seeks bail in a case registered under section 307 and other allied sections of the Indian Penal Code. Informant was driver of a bus which met an accident as a result of which one person died and after that the petitioner and other FIR named accused along with several other persons mercilessly assaulted the informant.

The impugned order shows that the informant sustained, altogether, six injuries out of which one injury on frontal bone was found grievous in nature.

Moreover, one FIR named co-accused Guddu Mandal has already been granted privilege of anticipatory bail by a coordinate bench of this court vide order dated 25.2.2016 passed in Cr. Misc. no.

Patna High Court Cr.Misc. No.12249 of 2016 (2) dt.29-03-2016 8859/2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in Amarpur P.S. Case no. 304/2015.
