JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.

Petitioner happens to be brother in law of the deceased and according to prosecution case, the relation of the deceased with his wife was not cordial and on the alleged date of occurrence, deceased had gone to take his wife back but subsequently, his dead body was found hanging with a tree. The cause of death of the deceased, in post mortem examination, was found asphyxia due to strangulation. Petitioner is named in the

Patna High Court Cr.Misc. No.12265 of 2016 (2) dt.29-03-2016 2/2 first information report but none has seen the actual killing of the deceased and moreover, having more or less similar allegation, coaccused, Ramanand Paswan has already been granted privilege of bail by this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 381 of 2015.
