The petitioner seeks bail in a case registered under Section 302 and other sections of the Indian Penal Code. A case under Section 302 of the Indian Penal Code was registered against unknown after recovery of a dead body. The wife of the deceased identified the dead body of her husband Surendra Yadav. During the course of investigation, it has come that one dreaded criminal Javed Miyan had illicit relation with the wife of the deceased and the wife of the deceased had given money to Javed Miyan and, that is why, Surendra Yadav (deceased) was killed by Javed Miyan in collusion with his wife. The police apprehended the petitioner and took his confessional statement. Except the confessional statement of the petitioner, the police did not collect any tangible evidence and submitted the

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Bodh Gaya P.S.
