Heard learned counsel for the parties.
This application for regular bail arises out of Dehri Town (Indrapuri O.P.) P.S. Case No. 301 of 2020 (Sessions Trial No.151 of 2020), registered for the offence punishable under Sections 147, 148, 149, 341, 326, 307, 506 and 120B of the Indian Penal Code and under Section 27 of the Arms Act. Subsequently, Section 302 of the Indian Penal Code was added. The petitioner's prayer for regular bail was earlier rejected by an order dated 11.01.2021 passed in Criminal Miscellaneous No.31553 of 2020. By making this application, the petitioner has renewed his prayer for bail. Learned counsel for the petitioner has submitted that two other co-accused persons namely, Bimlesh Kumar and Chhotu Kumar have been allowed regular bail by this Court by
Patna High Court CR. MISC. No.44734 of 2021(3) dt.22-09-2021 2/2 orders dated 16.12.202 and 23.11.2020 passed in Criminal Miscellaneous Nos. 33701 of 2020 and 29063 of 2020 respectively. He has submitted that evidently confession of coaccused is the only material collected in course of investigation. He has also submitted that co-accused Bimlesh Kumar, on whose confessional statement the petitioner's name surfaced in the F.I.R., has been allowed regular bail by this Court. Considering the above submissions, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned 19th Additional Sessions Judge, Rohtas at Sasaram, in Dehri Town (Indrapuri O.P.) P.S. Case No. 301 of 2020 (Sessions Trial NO. 151 of 2020).
This is subject to the condition that the petitioner shall present himself before the Police / Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bond shall be liable to be cancelled.
