The present writ petition has been filed directing the respondent authorities to pay appropriate compensation of the land situated at Plot No. 4764 /4763 Khata No.354/ 254 and area 12 decimal situated in Mauza- Ranipur, District-Patna. In this case, counter-affidavit and supplementary counter-affidavit have been filed from different sets and subsequently, in the counter-affidavit filed by the Executive Engineer, Rural Work Department, Work Division, Patna, it has

Patna High Court CWJC No.9753 of 2020(9) dt.28-06-2023 2/3 been communicated to the District Land Acquisition Officer, Patna that Executive Engineer has received a letter for payment of compensation of his land which is situated at Mauza- Ranipur Plot No. 4764 /4763, Khata No.354/ 254 and area 12 decimal in which request has been made in calculation of the compensation so that payment could be assured in favour of the petitioner. This letter is vide Memo No. 1580 dated 08.11.2022. In this background, counsel for State submits that State is ready to make payment to the petitioner upon receiving the calculation from the office of District Land Acquisition Officer.

Counsel for petitioner submits that in the light of inclination of the State authorities to pay the compensation and request for calculation, there is no need to continue this case pending and therefore, this case may be disposed of directing the respondent authorities fixing a probable time for payment of the compensation of its raiyati land.

Counsel for State assures that the payment shall be initiated within 3 months.

In this view of the matter, this case is disposed of with specific direction to the District Land Acquisition Officer, as well as to the Executive Engineer, Rural Work Department,
