2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 8(c), 21(c), 22(c) and 27(A) of the N.D.P.S. Act.

3. As per prosecution case, huge quantity of Phensedyl cough syrup has been recovered from a truck bearing Registration No. WB11E8082, of which this petitioner is alleged to be owner.

4. It is submitted by learned counsel appearing on behalf of the petitioner that no incriminating article has been recovered from the conscious possession of this petitioner and he has been made an accused in this case merely because he happens to be owner of the truck in question. Petitioner claims clean antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that huge quantity of cough syrup has been recovered from the truck of this petitioner.

6. Considering the aforesaid facts and circumstances and huge quantity of recovery from the truck of this petitioner, the prayer for grant of anticipatory bail to the petitioner is rejected.
