2. The petitioner seeks bail in connection with Durgawati P.S. Case No. 97 of 2025 registered for the offence under Section 126(2), 115(2), 137(2), 96, 64, 3(5) of the BNS and under Section 4 and 6 of the POCSO Act.

3. As per the prosecution case, the petitioner is the brother of the main accused Siwanu Kumar who is said to have committed rape upon the victim.

4. The petitioner is in custody since 1.4.2025.

5. Considering the fact that the petitioner is not the main accused, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge, VI-cumSpecial Judge, POCSO Act, Kaimur at Bhabhua/concerned Court below in connection with Durgawati P.S. Case No. 97 of 2025.
