JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier, the prayer for bail of the petitioner was twice rejected by this Court but while rejecting the prayer for bail of the petitioner on last occasion, this Court directed the trial court to conclude the trial of the petitioner as early as possible, preferably, within a period of eight months from the date of receipt/ production of copy of this order but the report of trial court reveals that the trial of the petitioner is still pending for recording of evidence of Investigating officer and some other non- official witnesses. Petitioner is in jail custody since 09.01.2012 and there is allegation against him that he gave single Barchchi blow

Patna High Court Cr.Misc. No.14827 of 2016 (3) dt.03-08-2016 2/2 causing head injury to the deceased, as a result thereof the deceased died.

Considering the facts and circumstances of the case as well as speed of the trial of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of 3rd Additional Session Judge, East Champaran, Motihari in connection with Session trial no. 268 of 2012, arising out of Pakridyal P.S.Case No. 59 of 2006, subject to the condition that if the petitioner makes any attempt to terrorize the remaining prosecution witnesses or shall make himself absent from the proceeding of the trial court on two consecutive dates without any reasonable cause, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner after due and proper inquiry.
